List of PFAS Added by Defense Bill Available

The US Environmental Protection Agency (EPA) has released a list of 160 per- and polyfluoroalkyl substances (PFAS) added by the 2020 National Defense Authorization Act (NDAA) to the Toxics Release Inventory (TRI) under Section 313 of the Emergency Planning and Community Right-to-Know Act (EPCRA). This list is effective January 1, 2020 and reporting will be due to EPA by July 1, 2021 for calendar year 2020 data.

The NDAA identifies 14 chemicals by name and/or Chemical Abstract Service Registry Number (CASRN) and identifies additional PFAS based on criteria for listings as an active chemical substance in the February 2019 update to the Toxic Substances Control Act (TSCA). EPA found 158 meet this TSCA criteria, including 12 of the 14 named chemicals bringing the total to 160 PFAS subject to listing under the NDAA.

EPA published an Advance Notice of Proposed Rulemaking (ANPRM) on December 4, 2019 seeking information from the public for potential rulemaking to add certain PFAS to the TRI list that are not included through the NDAA. EPA is soliciting comments on PFAS generally related to TRI reporting, appropriate reporting thresholds, PFAS categorizations, availability of human health and environmental toxicity information, persistence and bioaccumulation of additional PFAS that would help determine if they should be included on the TRI list of chemicals.
